Assessing the Impact of the Revision of Directive 98/8/EC Concerning the Placing of Biocidal Products on the Market

Project desription:

The overall objective of the study is to support the Commission in the preparation of the proposal for the revision of the Directive 98/8/EC Concerning the Placing of Biocidal Products on the Market (the BPD).The project is based on the study on the impact of the implementation of the BPD in which several proposals for amendments to the Directive were described. The objective of the new study is to assess the impacts of a series of potential amendments to the BPD. It will do this by identifying and evaluating the direct and indirect, positive and negative impacts related to the range of policy options available for addressing the current problems and shortcomings of the Directive on different stakeholders, including the industry and in particular the small and medium-sized enterprises, the Member States competent authorities, the formulators and the final users of biocidal products. The policy options to be evaluated address five main issues:

  • the scope of the Directive
  • product authorisation
  • data sharing
  • data requirements and
  • fees charged by Member States for carrying out the procedures of the Directive.

Fore each of these issues, a range of policy options will be evaluated, including in each case the ‘no action’ option (which will include minor corrections which the Commission may make to the Directive to clarify and make the current Directive work more smoothly). The Work Programme of the new study consists of the identification of issues to be addressed, the formulation and refinement of the policy options, the selection of key stakeholders, the evaluation of the economic, social and environmental impact of the policy options, and the consultation with stakeholders. The draft final report will be prepared by August 2008. Within the new study a targeted consultation of key stakeholders in the supply chain of selected sectors will be carried out with the objective of filling gaps, validation of issues and options, confirmation of stakeholder’s response to each of the policy options and obtaining more detailed data on the impacts.
